Birmingham man charged in collision with pedestrian

BAY MINETTE, Alabama — The driver of a vehicle that struck a pedestrian Saturday night in Bay Minette has been charged with assault and DUI and could face other charges following the victim’s death Sunday morning.
Heath Barrett, 23, of Atmore, died Sunday morning from injuries received when he was struck by a vehicle at approximately 9:56 p.m. Saturday as he attempted to cross the highway at the intersection of McMeans Avenue and West Fifth Street, according to a release issued Monday by Bay Minette Police Chief Al Tolbert.
The driver of the vehicle, identified as 24-year-old Andrew Milton Cross of Birmingham, was arrested and charged with first degree assault, driving under the influence, unlawful possession of marijuana, second degree; and unlawful possession of drug paraphernalia.
Cross is being held in the Baldwin County Sheriff’s Corrections Center and is scheduled to have a bond hearing at 2 p.m. today.
An additional fatality involving a pedestrian and a motor vehicle was reported over the weekend in Robertsdale, while two more were reported in Mobile County.

No charges have been filed in those cases.
The Robertsdale Police Department is investigating the death of a pedestrian struck on Alabama 59 Saturday night just south of Devine Road near the border between the Robertsdale and Loxley corporate limits.
RPD Chief Investigator Rex Bishop said Monday that they are still attempting to contact next-of-kin before identifying the woman who was struck by a southbound vehicle while attempting the cross the highway at approximately 9:30 p.m. Saturday.
The incident occurred north of Central Baldwin Middle School near Devine Road, which is on the northern edge of Robertsdale’s city limits and the southern end of Loxley’s town limits, but still within Robertsdale’s police jurisdiction, Bishop said.
“The driver remained on scene until officers arrived,” Bishop said, “and no charge have been filed.” The case remains under investigation.
Meanwhile Alabama State Troopers are investigating two fatalities involving vehicles striking pedestrians over the weekend in Mobile County, according to releases issued by the Alabama Law Enforcement Agency.
At approximately 5:20 a.m. Saturday, one of the passengers in a single-vehicle crash on I-10, west of McDonald Road, identified as 18-year-old Marques Freeman of Moss Point, Mississippi, was struck and killed.
No charges have been filed relating to the pre-dawn crash and the case remains under investigation by Alabama State Troopers.
Another fatal crash involving a vehicle and a pedestrian was reported shortly before 9:30 p.m. Sunday on Cuss Fork Road between Natchez Trace Road and Coleman Dairy Road. That victim has yet to be identified pending notification of next of kin.
