Posted

Orange Beach resident and former Trussville police officer David Wayne Montgomery, 51, surrendered to the Jefferson County Sheriff’s Office March 11 according to a press release from Attorney General Steve Marshall. He was released on $15,000 bond.

Attorney General Marshall’s Criminal Trials Division presented evidence to a Jefferson County grand jury, resulting in Montgomery’s indictment* Feb. 23. Specifically, the indictment charges him with one count of custodial sexual misconduct by engaging in sexual conduct with a female inmate in the custody of the Trussville City Jail.

No further information about the investigation or about Montgomery’s alleged crimes other than that stated in the indictment may be released at this time.

If convicted, Montgomery faces a maximum penalty of up to 10 years imprisonment and a fine of up to $15,000 for custodial sexual misconduct, a class C felony.

*An indictment is merely an accusation. The defendant is presumed innocent unless and until proven guilty.
