Letter challenges Leave Only Footprints law

GULF SHORES, AL – Former Attorney General Troy King’s law firm has sent a letter to the Gulf Shores mayor and city council asking it to halt the “Leave Only Footprints” program in that city.

King’s firm, representing Dean Young and Johnathan Young, says the law violates private property rights of beachfront owners. The new law states no items can be left on the beach overnight and any items left are picked up by city crews and discarded.

The lawsuit, in its concluding paragraph, states:

“In short, the city’s new enforcement techniques are a confiscatory departure from the plain language of the easement, the public explanations provided at the time the easements were executed and that were used to induce their execution, and over a decade of enforcement since the easements were first executed. We demand that Gulf Shores immediately cease and desist from interfering with the private property rights of its beachfront landowners.”

According to the Alabama Secretary of State’s off a Larry D. Young and Jonathan D. Young are either registered agents, organizers or members of IBEACHSERVICE LLC in the business of beach rentals. It was formed on Jan. 1, 2013 and the registered office street address is listed as 5341 Bay Drive, Orange Beach, AL.

On Feb. 8, 2013, Jonathan D. Young was added as a member, director, manager and organizer and Larry D. Young was removed from those same roles.

Both Gulf Shores and Orange Beach have similar ordinances and sweep the beaches clean of items left overnight daily. The program is considered a great success in both cities with little complaints from visitors or residents.
