SILVERHILL, Alabama — The Silverhill Town Council voted at its meeting Monday, Feb. 15 to table a measure to annex property into the town limits after it was determined that part of the property was recently purchased by the town.
The property, listed as the Kanne property, includes approximately 40 acres on the corner of Alabama 104 and County Road 49.
The council recently closed on 7.23 acres of property with plans to use part of the property for a water tower, voting at its Feb. 1 meeting to approve a resolution to purchase the property.
In March of 2020, the council agreed to move forward with a contract to purchase the property for $120,000.
Mayor Jared Lyles said the town had submitted the agreement to the property owners, who had one issue in regards to financing on the property. Council members agreed accept the changes and proceed forward with the purchase.
In December of 2019, council members discussed the possibility of using part of the property for a water tower. They also discussed using the property for fire department facilities, but it was unclear whether or not it could be used for that purpose.
Under the terms of the agreement, the sale price would be paid through owner financing from the seller to the town over a 20-year term.
After it was determined that the property recently purchased by the town is part of the proposed property for annexation, attorney Josh Myrick asked the council to table the measure so that the proper paperwork could be drawn up.
“It shouldn’t be an issue and it won’t take long for me to draw up the papers,” he said, “but when you’re dealing with property that has been purchased by the town, the law is very specific in the way you have to do it. I just want to make sure it’s done right.”
In other business Feb. 15, the council voted to approve a proclamation declaring March 5 as Arbor Day in the town. The proclamation is part of the town’s participation in the National Arbor Day Foundation’s Tree City program, which also requires the planting of a tree and holding an official Arbor Day tree giveaway program.
Silverhill will hold a drive-through tree giveaway from 9 a.m. to noon Friday, March 5 at the Silverhill Community Center, 21918 Third St.
From 9 to 11 a.m., Silverhill residents can choose two potted trees. All others are welcome beginning at 11 a.m.
The giveaway includes (3-gallon) Shumard oak, bald cypress, and Savannah holly; (1-gallon) crepe myrtles, purple and white.

The council also approved a measure to surplus a fire truck for the town’s Volunteer Fire Department and tabled a measure to join the Municipal Debris Removal Fund in order to have questions answered on how much the town would be required to contribute and how much the town could receive from the fund if needed.
The Robertsdale City Council also met Monday, Feb. 15 for a brief monthly meeting in which the city’s annual financial audit for 2020 was discussed and approved.
